1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you ("you," "User") and the operator of QuizHub.dev ("we," "us," "our," "Operator") governing your access to and use of the QuizHub.dev website, applications, and related services (collectively, the "Service"). By creating an account, signing in (including through a third-party identity provider such as Google), browsing, creating quizzes, taking quizzes, posting comments or messages, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

QuizHub.dev is a community platform that allows users to create, share, study, and discuss quiz-based educational content. Features may include user profiles, quiz authoring tools, quiz-taking and scoring, statistics, comments, discussions, ratings, and other interactive functionality. We may add, change, or remove features at any time without notice.

The Service is provided for general educational and community purposes. We do not guarantee that any quiz content is accurate, complete, current, suitable for professional certification exams, or endorsed by any third-party certifying body. You use all content at your own risk.

3. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction to consent to use online services) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You represent that you have the legal capacity to enter into these Terms and that you are not barred from using the Service under applicable law.

4. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

Information you provide must be accurate. You may not impersonate any person or entity, misrepresent your affiliation, or create accounts through automated or fraudulent means.

5. User content

"User Content" means any material you submit, post, display, or make available through the Service, including but not limited to quiz titles, descriptions, questions, answers, explanations, images, comments, discussion posts, messages, ratings, and profile information.

You retain ownership of your User Content as between you and us, subject to the license below. You represent and warrant that:

  • you own or have all necessary rights, licenses, and permissions to submit the User Content;
  • your User Content does not infringe any copyright, trademark, patent, trade secret, privacy, publicity, or other rights of any third party;
  • your User Content complies with these Terms and all applicable laws.

By submitting User Content, you grant the Operator a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, modify (for technical formatting), publish, display, distribute, and otherwise use your User Content solely to operate, promote, and improve the Service. This license continues for commercially reasonable backup and archival purposes after you remove content, until we delete it in the ordinary course of business.

6. Prohibited conduct and content

You agree not to use the Service to upload, post, or distribute content, or to engage in conduct, that:

  • is unlawful, fraudulent, defamatory, obscene, pornographic, harassing, threatening, hateful, discriminatory, or otherwise objectionable;
  • infringes or misappropriates intellectual property or other proprietary rights;
  • contains malware, viruses, phishing, spam, or deceptive schemes;
  • discloses personal information of others without lawful authority;
  • promotes violence, self-harm, or illegal drugs or weapons;
  • constitutes unauthorized advertising, solicitation, or commercial spam;
  • circumvents security or access controls, scrapes the Service at scale without permission, or interferes with operation of the Service;
  • uses the Service to cheat on proctored exams, violate academic integrity policies, or misrepresent professional credentials; or
  • violates any applicable law or regulation.

We have zero tolerance for child sexual abuse material (CSAM). We will report such material to appropriate authorities and cooperate with law enforcement.

7. No responsibility for user content; disclaimer

The Service may contain User Content created by users other than the Operator. We do not control, endorse, verify, or assume responsibility for User Content. Opinions expressed in quizzes, comments, or discussions are those of the users who posted them, not the Operator.

To the fullest extent permitted by law:

  • we are not liable for any errors, omissions, defamation, offensive content, or illegal material in User Content;
  • we are not responsible for disputes between users;
  • we do not guarantee the accuracy, quality, or safety of any quiz or discussion; and
  • your reliance on any User Content is solely at your own risk.

Nothing in these Terms obligates us to monitor User Content, but we reserve the right (without obligation) to review, remove, restrict, or disable access to any content or account at our sole discretion, with or without notice.

8. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to the contact address in Section 20, including:

  • identification of the copyrighted work;
  • identification of the infringing material and its location on the Service;
  • your contact information;
  • a statement of good-faith belief that use is not authorized;
  • a statement under penalty of perjury that your notice is accurate and you are authorized to act; and
  • your physical or electronic signature.

We may remove allegedly infringing material and terminate repeat infringers. Counter-notices may be submitted as provided by applicable law. We are not responsible for content uploaded by users; our role is limited to processing valid notices and taking appropriate action when required by law.

9. Community guidelines and moderation

We may publish separate community guidelines. In the event of conflict, these Terms control. We may warn, suspend, or permanently ban users who violate these Terms or who we believe harm the community. Moderation decisions are made in our sole discretion and are not subject to appeal except as we choose to offer.

10. Third-party services

The Service may integrate with third-party services (for example, Google Sign-In). Your use of those services is governed by the third party's terms and privacy policies. We are not responsible for third-party services.

11. Intellectual property of the Operator

The Service, including its design, software, logos, and branding (excluding User Content), is owned by the Operator or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted by these Terms or with our written consent.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that defects will be corrected.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Operator and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service, User Content, or conduct of other users, even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Operator and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or any law; or (d) your violation of any third-party rights. We may assume exclusive defense of any matter subject to indemnification at your expense.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately, without liability, for any reason, including violation of these Terms. Upon termination, provisions that by their nature should survive (including Sections 5–14 and 16–21) will survive.

16. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be indicated by updating the effective date and version. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service. For material changes, we may require you to accept updated Terms before continued use.

17. Dispute resolution and governing law

These Terms are governed by the laws of the United States and the state in which the Operator maintains its principal place of business, without regard to conflict-of-law principles. You agree to submit to the personal jurisdiction of courts located in that state for disputes not subject to arbitration, if any. Nothing limits rights that cannot be waived under applicable consumer protection laws in your jurisdiction.

18. Export and compliance

You agree to comply with all applicable export control and sanctions laws. You may not use the Service if you are located in, or a national of, a country subject to comprehensive U.S. sanctions, or if you are on a U.S. government denied-party list.

19. General

These Terms, together with the Privacy Policy and any posted guidelines, constitute the entire agreement between you and the Operator regarding the Service. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
